What happens after I fail or refuse a DOT drug or alcohol test? If you have a DOT drug or alcohol violation, you must immediately stop performing DOT safety-sensitive duties. Before you can return to safety-sensitive work, you must complete the DOT return-to-duty process with a qualified Substance Abuse Professional (SAP). The process includes an initial SAP evaluation, completion of the SAP’s recommended education and/or treatment, a follow-up SAP evaluation, and a return-to-duty test. How long does the SAP and return-to-duty process take? There is no set number of days for completing the SAP process. The timeline depends on the education and/or treatment recommended by your SAP and how quickly you successfully complete those requirements. After completing the SAP’s recommendations, you must have a follow-up evaluation. If your SAP determines that you have successfully complied, you may become eligible to proceed to return-to-duty testing. A SAP cannot skip required steps simply to get a driver back to work faster. Who has to pay for the SAP and does insurance cover it? DOT regulations do not require either the employer or employee specifically to pay for SAP evaluations, education, or treatment. Who pays may be determined by the employer, employee, applicable benefits, or a labor-management agreement. In many cases, drivers pay for their SAP services directly. Health insurance typically does not cover the SAP evaluation itself because it is an employment-related evaluation rather than traditional behavioral health treatment. However, if additional treatment is recommended, some treatment services may be covered depending on your insurance plan. Note: § 40.289 addresses responsibility for payment arrangements; it does not establish whether health insurance covers SAP services.
